These Terms of Service (the "Terms") are a legal agreement between you and Mockello ("Mockello," "we," "us," or "our"), operating from Chennai, Tamil Nadu, India. They govern your use of Featherweight Dictation: the Mac app, the website at dictation.featherweightsoftware.com, your Featherweight Dictation account, and the service behind them (together, the "Service").
Featherweight is a brand of Mockello.
By creating an account, installing the app, starting a trial, subscribing or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. You agree that accepting electronically forms a valid and binding agreement. If you do not agree, please do not use the Service. If you use Featherweight Dictation for an organisation, you confirm that you have authority to bind it, and "you" includes that organisation.
1. The short version
- What it is. A Mac menu bar app: hold a key, talk, let go, and your words are pasted where your cursor is.
- Free trial. 5 days or 3,000 words, whichever ends first. One trial per Mac.
- Then $5 a month for unlimited dictation, under fair use of up to 3 hours of speech a day.
- Cancel any time. You keep access until the end of the period you paid for. Payments are final, except where the law requires otherwise or checkout says so.
- AI can be wrong. Check the text before you rely on it or send it.
- Play fair. Use Featherweight Dictation lawfully, and do not abuse it, get around its limits or trials, or resell it.
- Indian law applies, and we try to resolve any dispute with you in good faith first.
2. What Featherweight Dictation does
Featherweight Dictation lives in your Mac's menu bar. Hold your chosen key (fn, right Option or right Command), talk, and let go. Your speech goes to our server, is turned into text by AI providers, is laid out for the app you are in, and is pasted where your cursor is. The Privacy Policy explains what is sent, where it goes and what we keep.
To work, Featherweight Dictation needs an internet connection and the Microphone and Accessibility permissions in macOS.
3. Eligibility and your account
You must be at least 18 years old, have reached the age of majority where you live, and be legally able to enter into these Terms.
You sign in through Clerk, with a one-time code sent to your email or with Google. You agree to:
- give accurate information;
- keep your email account, Google account and Macs secure;
- tell us promptly at hello@featherweightsoftware.com if you think someone has used your account without permission; and
- take responsibility for activity under your account.
An account is for one person. You may use it for personal or work dictation, but you may not share it.
You can use Featherweight Dictation on up to 7 Macs per account, and sign any Mac out from your account page to make room for another.
4. Free trial
- The free trial lasts 5 days or 3,000 words, whichever ends first.
- It starts the first time you sign in from a Mac.
- Each Mac gets one trial. A Mac that has already had a trial cannot start another, even with a different account.
- You do not need a payment card to start the trial, and it does not turn into a paid plan by itself. When it ends, dictation stops until you subscribe.
We may change or end trial offers for new users at any time. We may end a trial early if we reasonably believe it is being abused.
5. Plan, price and fair use
After the trial, Featherweight Dictation costs $5 a month for unlimited dictation. The price, currency and any taxes are shown at checkout.
Unlimited dictation has two limits:
- Fair use: up to 3 hours of speech a day per person. The day resets at midnight UTC.
- At once: at most 2 dictations are processed at the same time per person, across all your Macs.
If you reach a limit, dictation pauses until the day resets or your earlier dictations finish.
We may change prices going forward. A new price will not apply to a period you have already paid for, and we will give any notice the law requires before a new recurring price takes effect.
6. Payments, renewal and cancellation
6.1 Razorpay
Mockello sells the subscription. Payments are processed by Razorpay Software Private Limited ("Razorpay"), our payment gateway, in Razorpay's checkout, and Razorpay's terms and privacy policy also apply to your payment. You authorise us, through Razorpay, to charge your payment method for your subscription each month until you cancel, together with any taxes shown at checkout. Razorpay emails you a receipt for each payment and, where the rules on recurring payments require it, a notice before each renewal. We never receive your full card number or other payment details.
6.2 Renewal and cancellation
Your subscription renews automatically each month until you cancel, and you authorise the charge for each renewal. You can cancel any time:
- from your account page, with Cancel subscription; or
- by emailing info@featherweightsoftware.com.
When you cancel, you keep unlimited dictation until the end of the period you have paid for. After that, dictation stops until you subscribe again.
6.3 Refunds
Except as required by applicable law or as stated at checkout, payments are final and non-refundable once your paid access begins. This does not limit mandatory consumer rights, including rights and remedies under the Indian Consumer Protection Act, 2019 and applicable rules, or rights relating to deficient services, unfair trade practices or faulty digital content.
6.4 Failed payments and chargebacks
If a payment fails, we may pause unlimited dictation after giving any notice the law requires. Before starting a chargeback, please email info@featherweightsoftware.com so we can try to fix the problem. Fraudulent or abusive chargebacks may lead to suspension and recovery of amounts lawfully owed.
7. Your words and AI output
7.1 What you own
You keep ownership of what you dictate. As between you and Mockello, and to the extent the law allows, you own the text Featherweight Dictation produces for you (the "Output"), and we assign to you any rights we may have in it.
You give us a limited, worldwide license to process your audio and text, including through our service providers, only as needed to provide, secure and support the Service and to comply with law. We do not store your audio or your words.
7.2 AI can be wrong
Featherweight Dictation uses AI to hear your words and lay them out, and AI makes mistakes. It can mishear words, misspell names, drop or add words, change punctuation or meaning, or lay text out in a way you did not intend. The text is pasted wherever your cursor is when it arrives, so check where it lands.
You are responsible for checking the Output before you send, publish, submit or rely on it. Output is not professional advice. Do not use Featherweight Dictation as the only safeguard where a mistake could cause serious harm, such as in medical, legal, financial or safety-critical work.
7.3 Other people
If you dictate information about other people, or your recording picks up other voices, you are responsible for any permission or notice the law requires.
8. Acceptable use
You may not use Featherweight Dictation, or help anyone else use it, to:
- break the law, or infringe anyone's rights, including privacy and intellectual property rights;
- harass, threaten, deceive, defraud or harm anyone, or send spam or malware;
- abuse the Service, including by overloading it or interfering with its operation or security;
- get around fair use, the Mac limit, the limit on dictations at once or the one trial per Mac, for example by spoofing hardware identifiers;
- reverse engineer, decompile or disassemble the app, except where the law expressly allows it and that right cannot be waived;
- reverse engineer or scrape our API, or access it other than through the Featherweight Dictation app and website; or
- resell, rent, sublicense or share access to Featherweight Dictation, or offer it as part of another product or service.
We may investigate suspected violations and suspend or end access where reasonably necessary.
9. The app is licensed, not sold
Subject to these Terms, Mockello grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Featherweight Dictation app on Macs you own or control, for your personal or internal business use. The app is licensed, not sold. Mockello and its licensors keep all rights in Featherweight Dictation, including the app, the website, the Service, and the Featherweight name and branding.
Automatic updates. The app checks for updates and installs them on its own, and may restart itself to finish an update. Updates may fix problems, improve security, or add, change or remove features, and you agree to receive them. Older versions may stop working with the Service.
Open-source components are governed by their own licenses, and third-party names belong to their owners.
If you send us feedback, you grant Mockello a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or payment.
10. Changes to the Service
Featherweight Dictation relies on other companies, including xAI and OpenAI for speech and layout, Clerk for sign-in and Razorpay for payments. Outages or changes at those companies can affect the Service.
We may change, add or remove features, providers or limits, for reasons such as security, law, provider availability, cost or product development. If a change materially reduces what you get from an active paid subscription, we will tell you in advance where the law requires, and you can cancel.
11. Suspension and termination
You can stop using Featherweight Dictation at any time. Cancelling a subscription is covered in Section 6. To delete your account, email hello@featherweightsoftware.com.
We may suspend or end your access if:
- you materially or repeatedly break these Terms, or abuse the Service, the trial or its limits;
- payment fails or is reversed;
- your use creates a security, legal or fraud risk, or a risk of harm to others;
- the law, or a provider we depend on, requires it; or
- continuing to provide the Service is no longer reasonably possible.
Where appropriate, we will give notice and a chance to fix the problem first. We may act immediately where needed to prevent harm, fraud or abuse.
When your access ends, your license to use the app ends too. Sections that by their nature should survive, including payment obligations, ownership, disclaimers, limitation of liability, indemnity and disputes, will survive.
12. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." MOCKELLO AND ITS LICENSORS DISCLAIM ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT TRANSCRIPTIONS OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE OR SUITABLE FOR YOUR PURPOSE.
Nothing in these Terms excludes a warranty, guarantee or consumer right that cannot lawfully be excluded.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCKELLO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR OPPORTUNITY; COST OF REPLACEMENT SERVICES; OR DAMAGE ARISING FROM AI OUTPUT, TEXT PASTED INTO OTHER APPS OR THIRD-PARTY PROVIDERS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MOCKELLO AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID FOR MOCKELLO LITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- US$100.
These limitations do not apply to liability that cannot lawfully be limited, which may include liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
14. Indemnity
If you use Featherweight Dictation for a business or other commercial purpose, you will defend, indemnify and hold harmless Mockello and its affiliates, officers, employees, contractors, licensors and service providers from third-party claims, losses, liabilities, damages, costs and reasonable legal fees arising from:
- your dictated content or your use of the Service;
- your breach of these Terms or applicable law; or
- your infringement or violation of another person's rights.
This section does not apply to the extent a claim was caused by Mockello's breach, negligence or wilful misconduct, or where indemnity is prohibited by consumer law.
15. Governing law and disputes
Before starting formal proceedings, you and Mockello agree to try in good faith to resolve the dispute, starting with a written description of the issue and the resolution you want, sent to hello@featherweightsoftware.com. We will acknowledge consumer grievances within 48 hours and seek to resolve them within one month, as applicable. This does not prevent either party from seeking urgent injunctive relief or using a consumer commission, small-claims process, regulatory complaint process or other forum available under mandatory law.
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory consumer rights and any forum that cannot lawfully be excluded, the courts of competent jurisdiction at Chennai, Tamil Nadu, India will have exclusive jurisdiction.
If you are a consumer, this section does not take away protections or dispute forums that cannot be waived under the law where you live.
16. Changes to these Terms
We may update these Terms as Featherweight Dictation, the law or our business changes. We will post the revised Terms here and update the "Last updated" date. If a change materially and adversely affects an active subscription, we will give additional notice where required.
Changes apply going forward. If you do not agree to a change, stop using Featherweight Dictation and cancel your subscription.
17. General terms
- Assignment. You may not transfer your account or these Terms without our written consent. We may assign these Terms as part of a merger, reorganisation, financing or sale of our business or assets.
- No waiver. A failure to enforce a provision is not a waiver.
- Severability. If a provision is unenforceable, it will be limited to the minimum extent necessary, and the rest will continue in effect.
- No third-party beneficiaries. These Terms do not create rights for anyone other than you and Mockello.
- Force majeure. Neither party is liable for delay or failure caused by events beyond reasonable control, except payment obligations.
- Entire agreement. These Terms, together with any terms shown at checkout, are the complete agreement between you and Mockello about Featherweight Dictation.
- Electronic communications. You agree that we may give notices and records electronically, including by email, subject to applicable law.
